I, the undersigned, hereby apply for Exhibitor Booths at the Round Valley Blackberry Festival (RVBF) to be held on August 19th and 20th, 2017.
This application is for rental of up to three (3) booths in a location to be specified by the RVBF Committee.
Rental on booths shall be $80.00 for the 2 day festival period. Said rental fee must be received after approval by the RVBF Committee. Once accepted said RENTAL FEE WILL NOT BE REFUNDED.
Booth hours of operation shall be from 10:00AM until 6:00PM on Saturday and 10:00AM until 5:00PM on Sunday. All booths must be cleared of all Exhibitors’ items, wares, and other personal property and all trash and other debris removed from the grounds no later than 6:00PM Sunday, August 20, 2017.
Water is available on site, but not inside the booth. There will be no alterations, modifications, or structural changes made to any booth by Exhibitor without specific prior approval, in writing, from the RVBF Committee. Exhibitor shall be liable for any and all damages to the booth assigned to the Exhibitor.
The number of exhibitor booths is limited and selection of participating Exhibitors shall be at the sole discretion of the RVBF Committee. In addition, acceptance by the RVBF Committee may be conditional, in that the RVBF Committee reserves the right to prohibit the exhibition or sale of any items or wares, which in the sole opinion of the RVBF Committee, are not in keeping with the “FAMILY THEME” of the festival. Please note: no weapons of any kind (real or toy) are allowed on the festival grounds. No soaker guns or water pistols of any kind are permitted on the grounds.
All Exhibitors shall be responsible for maintaining their booths and the surrounding area in a safe, neat, and clean condition. All booths and the area immediately surrounding, will be kept clean and free of trash, litter and other debris by Exhibitor throughout the duration of the Festival and upon Exhibitor’s departure at the close of the Festival.
There shall be no alcoholic beverages served, sold, and/or consumed at, or in the immediate vicinity of any Exhibitors’ booth. All alcoholic beverages consumed must be purchased from approved vendors at the Blackberry Festival.
All exhibitors must comply with the instructions or directions of the RVBF Committee, or designated representative, throughout the entire Festival period; including the periods of initial set-up and departure. Failure to comply with all instructions and directions associated with the operation of Exhibitor booths, or Festival events and activities, shall constitute a breach of this agreement and shall immediately terminate rental.
Exhibitors are solely responsible for their exhibit, property and/ or wares and hereby agree to hold the RVBF Committee, its parent organization, and all persons associated therewith, free and harmless from any and all loss, claims, or damages arising from, or in any manner associated with, their exhibit, personal property, and/or wares. The RVBF Committee, its parent organization and all persons associated therewith, disclaim and accepts no responsibility or liability for any Exhibitor or any activity or event connected with the RVBF. Exhibitors hereby agree to indemnify and hold harmless, the RVBF Committee, its parent organization, and all persons associated therewith, for any expense, including, but not limited to, attorney’s fees, arising from such loss, claim or damage.
This application contains the entire agreement between the parties hereto, and may be modified only by a written statement signed by the RVBF Committee and the Exhibitor.
Should any provision of this agreement be deemed invalid or unenforceable by a court of competent jurisdiction, all other provisions of the agreement shall remain in full force and effect.
In the event legal action should be necessary, arising from, or to enforce any term of this agreement or modification thereof, the prevailing party shall, in addition to such other relief as may be proper, be entitled to all costs of suit, to include attorney’s fees.
Mendocino County Health Ordinance prohibits any animals on the premises.
